Sell To Win

  1. CONTEST PERIOD:
    The Sell To Win Contest (the “Contest”) begins on January 21, 2018 at 9:00 a.m. Eastern Time (“ET”) and ends on December 10, 2018 at 6:00 p.m. ET (the “Contest Period”).
  2. ELIGIBILITY:
    Contest is open to residents of Ontario who have reached the legal age of majority in their province/territory of residence at the time of entry, except employees, representatives or agents (and those with whom such persons are domiciled, whether related or not) of PSR Brokerage Ltd. (the “Sponsor”), its subsidiaries, affiliates, prize suppliers, advertising/promotion agencies and any entity involved in the development, production, implementation, administration, judging or fulfillment of the Contest (collectively, the “Contest Parties”).
  3. HOW TO ENTER:
    AUTMATIC ENTRY: You will automatically receive one entry (an “Entry”) into the Contest draw if you meet all of the following criteria:
    1. During the Contest Period you list your residence that is located in Ontario (the “Residence”) for sale using Jordan Grosman Group as the sole selling agent for the Residence
    2. the Residence is sold (based on legal closure of the agreement of purchase and sale) during the Contest Period and Jordan Grosman Group remains the sole selling agent at the time of closure.
    NO PURCHASE NECESSARY: To receive an Entry without a purchase, mail in a minimum 100-word, hand written, original essay about the following topic: “Why is Toronto the Best Place to Live?” and including your name, mailing address, email address and telephone number to “Sell To Win” Jordan Grosman Group, PSR Brokerage Ltd., 672 Dupont Street, Suite 101, Toronto, ON M6G 1Z6. Mail-in entries must be post-marked by December 10, 2018 and received by December 15, 2018 at noon ET. Each mail-in entry must be mailed in a separate, postage-paid envelope. All requests become the exclusive property of Sponsor. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, illegible, misdirected or postage-due entries, which will not be honoured.
    There is a limit of one (1) Entry permitted during the Contest Period, regardless of the method of entry. If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to:
    1. Obtain more than one Entry per person during the Contest Period; and/or
    2. Use (or attempt to use) multiple names or identities to enter or otherwise participate in or disrupt this Contest; then he/she may be disqualified from the Contest in the sole and absolute discretion of the Sponsor.
    All Entries are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification):
    1. For the purposes of verifying an individual’s eligibility to participate in this Contest
    2. For the purposes of verifying the eligibility and/or legitimacy of an Entry entered (or purportedly entered) for the purposes of this Contest; and/or
    3. For any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with these Rules.
    Failure to provide such proof to the satisfaction of the Sponsor in a timely manner may result in disqualification in the sole and absolute discretion of the Sponsor. The sole determinant of the time for the purposes of a valid Entry in this Contest will be the Sponsor’s Official Clock(s).
  4. THE PRIZE AND APPROXIMATE RETAIL VALUE:
    There will be one (1) prize available to be won as follows:
    1. If the winner entered by means of automatic Entry, the winner will receive a cheque equal to the dollar amount of the selling commission (as agreed to under the Listing Agreement) that Jordan Grosman Group earned on the sale of the Residence associated with that Entry, up to a maximum of $50,000 CAD. If there is more than one individual listed as the seller on the purchase and sale agreement for that Residence, the prize amount will be split evenly amongst each such listed seller and each such individual will be considered a potential winner and will be required to comply with the requirements set out below. By way of example, if the Residence was sold for $1,500,000 and the selling commission is 2.5%, then the winner will receive $37,500. Using that same example, if there were two individuals listed as sellers of the Residence, they would each receive $18,750. If the Residence was sold for $3,000,000 and the selling commission is 2.5%, then the winner will receive $50,000; or
    2. If the winner entered via a mail-in Entry, the winner will receive $50,000 (the “Prize”).
    Prize must be accepted as awarded and is not transferable or assignable. No substitutions except at Sponsor’s option. Prize will only be awarded to the person whose verifiable full name appears on the purchase and sale agreement or on the mail-in Entry as applicable.
  5. RANDOM PRIZE DRAW AND WINNER SELECTION:
    On December 17, 2018 (the “Draw Date”) in Toronto, Ontario at approximately 12.00 p.m. ET, one (1) eligible Entry will be selected by random draw from among all eligible Entries submitted and received during the Contest Period in accordance with these Rules. The odds of winning depend on the number of eligible Entries submitted and received during the Contest Period in accordance with these Rules.
    The Sponsor or its designated representative will make a minimum of three (3) attempts to contact the potential winner (or if there is more than one seller for the selected Entrant then each such potential winner) within five (5) business days of the Draw Date. If a/the potential winner cannot be contacted within five (5) business days of the Draw Date, or if there is a return of any notification as undeliverable; then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate potential winner from among the remaining eligible Entries (in which case the foregoing provisions of this section shall apply to such newly selected entrant). However, in the event there is more than one potential winner associated with a selected Entry, and one potential winner is disqualified, that disqualification will not impact any other potential winner associated that that selected Entry and such other potential winners will still be able to win his/her portion of the Prize provided he/she complies with the requirements set out in these Rules. For example, if there are three sellers listed on an agreement of purchase and sale and that Entry is selected as the potential winner, and if one of the sellers is disqualified, only that seller’s potential prize winning (equal to 1/3 of the Prize value) will be forfeited and the two remaining sellers are still eligible to win their own portions of the Prize value. For greater certainty, the remaining potential winners are not eligible to win the disqualified individual’s share of the Prize and that portion will not be otherwise awarded.
    BEFORE BEING DECLARED THE CONFIRMED PRIZE WINNER, the selected entrant will be required to:
    1. Correctly answer a mathematical skill-testing question without mechanical or other aid; and
    2. Sign and return within five (5) business days of notification the Sponsor’s declaration and release form, which (among other things):
      1. Confirms compliance with these Rules
      2. Acknowledges acceptance of the Prize (as awarded)
      3. Releases the Contest Parties, and each of their respective officers, directors, agents, representatives, successors and assigns (collectively, the “Released Parties”) from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Prize or any portion thereof; and
      4. Agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including print, broadcast or the internet
    If the selected entrant:
    1. Fails to correctly answer the skill-testing question
    2. Fails to return the properly executed Contest documents within the specified time
    3. Cannot accept (or is unwilling to accept) the Prize (as awarded) for any reason; and/or
    4. Is determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate eligible entrant from among the remaining eligible Entries (in which case the foregoing provisions of this section shall apply to such newly selected entrant).
    However, in the event there is more than one potential winner associated with a selected Entry, and one potential winner is disqualified, that disqualification will not impact any other potential winner associated that that selected Entry and such other potential winners will still be able to win his/her portion of the Prize provided he/she complies with the requirements set out in these Rules. For greater certainty, the remaining potential winners are not eligible to win the disqualified individual’s share of the Prize and that portion will not be otherwise awarded.
  6. GENERAL CONDITIONS:
    All Entries become the property of the Sponsor. This Contest is subject to all applicable federal, provincial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries, and/or entrants. By participating in this Contest, you are agreeing to be legally bound by the terms and conditions of these Rules.
    ANYONE DETERMINED TO BE IN VIOLATION OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME.
    The Released Parties will not be liable for the failure of any Entry to be received, captured or recorded for any reason.
    The Sponsor reserves the right, in its sole and absolute discretion, to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of an error, tampering, unauthorized intervention, fraud, or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules. Any attempt to deliberately undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor reserves the right, in its sole and absolute discretion, to cancel, amend or suspend this Contest, or to amend these Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever. Without limiting the generality of the forgoing, the Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law.
    By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her Entry only for the purpose of administering the Contest
    The Sponsor reserves the right, in its sole and absolute discretion, and without prior notice, to adjust any of the dates and/or timeframes stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or Entry with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.
    In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to print or online advertising; the terms and conditions of these Rules shall prevail, govern and control to the fullest extent permitted by law.
